Loubna Ali Jaafar: Brags About Impunity to Enslave and Murder Her Worker

THE STORY
Loubna Ali Jaafar, born April 2, 1979, lives in Baalbek. She brought Shukurat, a 24 year old Nigerian, to work for her on 14 May, 2019. Shukurat’s accommodation was a sponge mattress on the kitchen floor next to a storeroom. She suffered from severe sleep deprivation as Shukurat contends that whenever she was trying to sleep, Loubna would want to access the storeroom.
Shukurat contacted This Is Lebanon in May 2020 to protest about not having received her salary. At that stage she reported she was owed 5.5 months salary. She said whenever she asked Loubna for payment, Loubna would reply that there are no dollars but “soon the dollar will be good again” and she would pay her then. Shukurat wrote, “I noticed that anytime I ask for my money she will not stay at home, she will not want to see me.” Shukurat called the agent to inform him of her situation.
He threatened, “If you come back here, you will not like it.” At that stage, Shukurat still had hope of being paid and wanted to stay in Lebanon so we did not intervene. She contacted us again in October. By then she was owed 8 months. She had given up hope of being paid and wanted to go home.

The option of escaping was discussed with Shukurat. She said it would be difficult as there were CCTV cameras. She knew of two Ghanaian girls who had escaped due to non-payment and their employers laid false accusations of theft against them. “And the madams say that if they see them they will go to jail and I am afraid of that.” This was a realistic fear. Many unpaid domestic workers are languishing in Lebanese prisons on false accusations of theft. Shukurat asked a taxi driver to take her to Beirut but he wanted 200,000 LL - an amount she did not have.
We notified the Nigerian Embassy about Shukurat and a staff member phoned Loubna. Loubna said she was outside the house and asked her to call back. After that she ignored all calls from the Embassy.

In December 2020, This Is Lebanon contacted Loubna offering to buy Shukurat a ticket home if she paid the unpaid salary. There was a problem - Loubna had bought Shukurat from another employer but had never done her papers so she was undocumented. Shukurat was pressing Loubna for her salary. Loubna tried to get Shukurat to accept payment at the rate of 200,000 LL per month. Shukurat refused as this was then worth less than $25. At the same time she was telling Shukurat that she had to work another four months to “finish her contract,” despite the fact that she had not paid her for nine months.
Loubna eventually stopped answering our calls and replying to messages from Shukurat’s family. We then advised her to stop working.
“They’re slaves. No matter how well you treat them, they are slaves.”
After Shukurat refused to work, things came to a head. In a call to Loubna, she said, “In the Jaafar family, if she did something we’d kill her. We wouldn’t feel any shame. We’d kill her.” She went on to say, “They’re slaves. No matter how well you treat them, they are slaves.”
We negotiated for her to send Shukurat in a taxi to Beirut. She said Shukurat had a ‘dirty character’ and she didn’t want her back. Loubna gave her 2,100,000 LL in payment for the 9 months she owed her (the equivalent of $250 at that day’s exchange rate). In Beirut, Shukurat was met by a volunteer from This Is Lebanon who arranged a shelter for her.
Shukurat was paid a total of $1953. She should have received $4000. This is a shortfall of $2047. This Is Lebanon bought Shukurat’s ticket and she arrived back in Nigeria on the 27th of February. We then sent Loubna the video with the following message: “Dear Ms. Loubna Jaafar,You have not paid Shukurat all of her salary. You confirmed that you did not pay all her salary when we spoke to you several times. It is not ethical or righteous that you don’t pay a worker her rightful salary. You are god-fearing people and you must pay her her salary. We have only sent you the video. We will not send it to anyone else. Are you willing to pay her salary? We are happy to negotiate and reach a deal. I am sure we can reach an agreement. Mariam (This Is Lebanon)”
Loubna responded with threats that she would "find" and "kill" Mariam.

تعيش لبنى علي جعفر، تولّد 4/2/1979، في بعلبك. قامت بإحضار شوكورات، النيجيرية والبالغة من العمر 24 عاماً، للعمل لديها في 14 أيار 2019. كان مكان إيواء شوكورات عبارة عن فراش من الإسفنج على أرضية المطبخ بجوار غرفة التخزين (انظر الصورة). وقد عانت من الحرمان الشديد من النوم حيث تقول شوكورات أنها كلما حاولت النوم، كانت لبنى تريد الدخول إلى غرفة التخزين. اتصلت شوكورات بجمعية "هذا لبنان" في أيار 2020 تشكو من عدم دفع الراتب. في تلك المرحلة، ذكرت أنهم يدينون لها براتب 5 أشهر ونصف الشهر. وقالت إنها كلما طلبت من لبنى أن تدفع لها، كانت ترد عليها قائلة بأنه لا يوجد دولارات ولكن "قريباً سيتحسن وضع الدولار مرة أخرى" وحينئذ ستدفع لها. كتبت شوكورات: "لاحظتُ أنه كلما طلبتُ نقودي، لا تبقى في المنزل، ولا ترغب في رؤيتي". اتصلت شوكورات بالوكيل لتخبره عن وضعها. فهدّدها قائلاً: "إذا عدتِ إلى هنا، فلن يعجبك ذلك." في تلك المرحلة، كانت شوكورات لا تزال تأمل في الحصول على أجرها وأرادت البقاء في لبنان لذلك لم نتدخل. اتصلت بنا مرة أخرى في تشرين الأول. بحلول ذلك الوقت كانوا يدينون لها برواتب 8 أشهر. لقد فقدت الأمل في الحصول على أجرها وأرادت العودة إلى بلدها.
"بالنسبة لعائلة جعفر، إذا فعلتْ شيئاً سنقتلها. لن نشعر بأي خجل. سنقتلها".
ناقشنا خيار الهروب مع شوكورات. فقالت بأنه سيكون صعباً بسبب وجود كاميرات مراقبة. وقد سمعَتْ عن فتاتين من غانا هربتا بسبب عدم الدفع فقام أصحاب عملهما بتوجيه اتهامات كاذبة لهما بالسرقة. "وتقول السيدتان أنهما إن رأياهما فسوف تدخلان السجن وأنا أخاف ذلك." لقد كان هذا خوفاً حقيقياً. تقبع في السجون اللبنانية العديد من عاملات المنازل اللواتي لم تقبضن أجورهن وذلك باتهامات كاذبة بالسرقة. طلبت شوكورات من سائق سيارة أجرة أن يأخذها إلى بيروت لكنه طلب 200 ألف ليرة - وهو مبلغ لم يكن بحوزتها.
قمنا بإبلاغ القنصلية النيجيرية بشأن شوكورات فاتصلت إحدى الموظفات بلبنى. أخبرتها لبنى بأنها خارج المنزل وطلبت منها معاودة الاتصال. بعد ذلك تجاهلت جميع المكالمات من القنصلية.

وفي كانون الأول 2020، اتصلت جمعية "هذا لبنان" بلبنى وعرضت عليها بأنهم سيشترون تذكرة العودة لشوكورات في حال دفعت لها الراتب غير المدفوع. واجهتنا مشكلة - لقد اشترت لبنى شوكورات من صاحب عمل آخر لكنها لم تستكمل لها أوراقها قط، لهذا فهي غير نظامية. كانت شوكورات تضغط على لبنى للحصول على راتبها. حاولت لبنى إقناع شوكورات بقبول أن تتم عملية الدفع بمعدل 200 ألف ليرة لبنانية شهرياً. فرفضت شوكورات لأن هذا كان يساوي أقل من 25 دولاراً. في الوقت نفسه، كانت تقول لشوكورات بأن عليها العمل 4 أشهر أخرى "لإنهاء عقدها"، على الرغم من أنها لم تدفع لها مقابل 9 أشهر.
توقفت لبنى عن الرد على مكالماتنا والرد على رسائل عائلة شوكورات. نصحناها بالتوقف عن العمل.

بعد أن رفضت شوكورات متابعة العمل، وصلت الأمور إلى ذروتها. وفي اتصال مع لبنى قالت لنا: "بالنسبة لعائلة جعفر، إذا فعلتْ شيئاً سنقتلها. لن نشعر بأي خجل. سنقتلها". ومضت تقول، "إنهم عبيد. بغض النظر عن مدى معاملتك لهم، فهم عبيد".
تفاوضنا معها لكي ترسل شوكورات في سيارة أجرة إلى بيروت. فقالت إن شوكورات لها "شخصية دنيئة" ولا تريدها أن تعود. أعطتها لبنى مبلغ 2،100،000 ليرة لبنانية كدفعة عن الأشهر التسعة المستحقة لها (ما يعادل 250 دولاراً بسعر الصرف في ذلك اليوم). في بيروت، قامت متطوعة من جمعية "هذا لبنان" باستقبال شوكورات ودبرت لها مأوى.
تم دفع مبلغ إجمالي قدره 1953 دولاراً لشوكورات. كان يجب أن تحصل على 4000 دولار. مما يشكل عجزاً قدره 2047 دولار. اشترى "هذا لبنان" تذكرة شوكورات وعادت إلى نيجيريا في 27 شباط. ثم أرسلنا الفيديو إلى لبنى مرفقاً بالرسالة التالية: "حضرة السيدة لبنى جعفر، لم تدفعي لشوكورات كامل راتبها. وقد أكّدتِ أنك لم تدفعي راتبها بالكامل حين تحدثنا إليك عدة مرات. ليس من الأخلاقي أو المنصف ألا تدفعي للعاملة راتبها المستحق. أنتم تخافون الله وعليكم أن تدفعوا لها راتبها. لقد أرسلنا لك الفيديو فقط. لن نرسله إلى أي أحد آخر. هل أنتِ على استعداد لدفع راتبها؟ نحن سعداء للتفاوض والتوصل إلى اتفاق. أنا متأكدة من أنه يمكننا التوصل إلى اتفاق. ميريام من "هذا لبنان".
