JJ, a 25-year-old Kenyan, survived 19 months of abuse in Lebanon—sexually harassed, unpaid, and jailed while her abuser walked free. Her story exposes the brutal reality of Lebanon’s kafala system and those who exploit it.

THE STORY
JJ, a 25 year old Kenyan, arrived in Lebanon in late 2023. She experienced multiple abuses, such as unpaid wages, physical and sexual abuse, confiscation of her passport, detention, and salary theft by her illegal agent. Over 19 months in Lebanon, she worked for six different employers, five of whom short-paid her or paid her salary to the agent who pocketed it. These irregularities reflect a broader pattern of exploitation faced by many migrant workers in Lebanon.
One of the most alarming incidents involved an attempt by her last employer to sexually assault her. For just under four months, JJ had to contend with constant sexual harassment and an attempted rape by her employer, Hassan Kawtharani. On one occasion, JJ was able to secretly record him on her phone. He can be heard saying,
“Look at it. It's up. It's staying up and no one is here. Do you want to sit on it?”
He was exposing his penis at the time.
JJ’s trauma was compounded by the fact that her agent, Mortada Ghazali, an unregistered broker who works illegally in full view of the Lebanese government, is Kawtharani’s nephew. He reportedly instructed Kawtharani to take JJ somewhere to hide her from the authorities in an effort to avoid accountability.
When JJ was eventually taken to the police station following a complaint lodged by the consulate, the police detained JJ instead of the sex offender. She was kept for three weeks in a small, windowless cell with ten other women. She slept on the floor and was addressed as ‘Criminal’ by the policemen. She was then transferred to the Detention Centre, a place often associated with poor conditions and loss of dignity, for a further 3 weeks.
Throughout her ordeal, This Is Lebanon provided critical assistance - from the time she contacted our page saying,
“Hey please help me. My life is in danger in Marwenieh”
until the time she safely reached home. While in transit in Dubai we were able to send her financial assistance so that she could travel home from the Nairobi airport.
Despite JJ playing her audio evidence of sexual abuse to the police, Kawtharani is a free man and may have a new victim. JJ has chosen to share her story in order to help protect any other worker going into that house.
The illegal agent, Mortada Ghazali, continues to operate. He is the abuser in multiple cases reported to This Is Lebanon.
In conclusion, JJ’s case reflects the severe risks faced by migrant domestic workers in Lebanon who are specifically excluded by the labour laws and are legally tied to their employers under the abusive kafala system. If JJ had been able to change employers, it is unlikely she would have had to suffer the abuse which she is still healing from.

Kafala (the Arabic word for sponsorship) refers to the set of regulations and administrative practices used to sponsor and employ migrant workers in Lebanon, mostly women from African and Asian countries working for private households. Domestic workers are excluded from Lebanese labor law and lack basic protections. The kafala system protects abusers and denies domestic workers of basic human rights. The high degree of control over workers’ rights provided by the kafala system has led to cases of modern slavery, human trafficking, and exploitation.

جي جي، شابة كينية تبلغ من العمر ٢٥ عاماً، وصلت إلى لبنان في أواخر عام ٢٠٢٣. خلال إقامتها، تعرضت لعدة أشكال من الانتهاكات، شملت عدم دفع الأجور، التعنيف الجسدي والجنسي، مصادرة جواز سفرها، احتجازها، وسرقة راتبها من قبل وكيلها غير الشرعي. وخلال فترة إقامتها التي امتدت ١٩ شهراً، عملت جي جي لدى ستة أرباب عمل، قام خمسة منهم إما بدفع أجور ناقصة أو تحويل راتبها إلى وكيلها الذي استولى عليه. تعكس هذه التجاوزات نمطاً واسع الانتشار من الاستغلال الذي يعاني منه العديد من العمال المهاجرين في لبنان.
من بين أكثر الحوادث فظاعة، محاولة رب عملها الأخير التحرش الجنسي بها. وعلى مدار أربعة أشهر تقريباً، واجهت جي جي تحرشاً جنسياً مستمراً ومحاولة اغتصاب من قبل صاحب العمل، حسن كوثراني. وفي إحدى المناسبات، تمكنت من تسجيله سراً عبر هاتفها المحمول، حيث يُسمع صوته وهو يقول:
"انظري إليه. إنه منتصب. سيبقى كذلك ولا أحد هنا. هل تريدين الجلوس عليه؟"
وكان حينها مكشوف العورة.
تفاقمت صدمة جي جي عندما علمت أن وكيلها مرتضى غزالي، وهو وسيط غير مرخّص ويعمل بصورة غير قانونية تحت مرأى الدولة اللبنانية، هو ابن شقيق كوثراني. وبحسب التقارير، فقد طلب غزالي من كوثراني أخذ جي جي إلى مكان بعيد لإخفائها عن أعين السلطات، في محاولة للهروب من المساءلة القانونية.
وعندما تم اقتياد جي جي أخيراً إلى مركز الشرطة عقب شكوى تقدمت بها القنصلية، قامت الشرطة باعتقالها بدلاً من المتحرش. واحتُجزت في زنزانة صغيرة من دون نوافذ مع عشر نساء أخريات لمدة ثلاثة أسابيع، تنام على الأرض ويُنادى عليها بـ"مجرمة" من قبل عناصر الشرطة. ثم نُقلت إلى مركز الاحتجاز، المعروف بظروفه السيئة وغياب الكرامة الإنسانية، حيث بقيت لثلاثة أسابيع إضافية.
وخلال هذه المحنة، قدمت منظمة "هذا لبنان" دعماً حاسماً منذ اللحظة التي تواصلت فيها جي جي معنا قائلة:
"مرحبًا، أرجو المساعدة، حياتي في خطر في المروانية"
حتى لحظة عودتها إلى وطنها بأمان. وخلال وجودها في دبي ترانزيت، قمنا بتحويل مبلغ مالي لها لتتمكن من استكمال رحلتها من مطار نيروبي إلى منزلها.
ورغم أن جي جي قدمت للشرطة تسجيلاً صوتياً يوثق تحرش كوثراني بها، فإنه لا يزال حراً طليقاً وقد يكون لديه ضحية جديدة الآن. وقد قررت جي جي مشاركة قصتها للمساعدة في حماية أي عاملة أخرى قد تدخل إلى ذلك المنزل.
أما الوكيل غير الشرعي، مرتضى غزالي، فلا يزال يمارس نشاطه، وهو متورط في عدة حالات اعتداء أبلغت بها منظمة "هذا لبنان."
في الختام:
تعكس قضية جي جي المخاطر الجسيمة التي تواجهها العاملات المنزليات المهاجرات في لبنان، واللواتي يُستثنين من قانون العمل اللبناني ويُجبرن قانوناً على البقاء تحت سلطة أصحاب العمل بموجب نظام الكفالة الاستغلالي. ولو كانت جي جي قادرة على تغيير صاحب العمل، لَما اضطرت لتحمل هذه الانتهاكات التي لا تزال تتعافى منها حتى اليوم.

حول منظمة "This Is Lebanon"
تأسست منظمة "This Is Lebanon" عام ٢٠١٧ بهدف العمل على إلغاء نظام الكفالة في لبنان. وتسعى المنظمة إلى تسليط الضوء على مخاطر هذا النظام من خلال فضح الظروف المروعة التي تعيشها العاملات المنزليات المهاجرات، وكشف هوية المعتدين، إضافةً إلى مناصرة حقوق العاملات والدفاع عنهن. وفي نهاية المطاف، تعمل المنظمة على إيصال صوت العاملات وتشجيع الشهود على التبليغ عن الانتهاكات.
ما هو نظام الكفالة؟
نظام الكفالة هو مجموعة من القوانين والممارسات الإدارية التي تُستخدم لرعاية وتشغيل العمال المهاجرين في لبنان، وغالبًا ما تكون النساء من دول إفريقية وآسيوية يعملن في المنازل. تُستثنى العاملات المنزليات من قانون العمل اللبناني، وبالتالي يفتقرن إلى الحماية القانونية الأساسية. يوفر نظام الكفالة غطاءً قانونياً للمعتدين ويحرم العاملات من أبسط حقوق الإنسان. وقد أدى التحكم الكبير الذي يمنحه النظام لصاحب العمل إلى انتشار حالات من العبودية الحديثة والاتجار بالبشر والاستغلال.
